Court of Appeal confirms principle of presumption in favour of insured in public liability insurance case

Whilst burning off paint, a building contractor inadvertently started a fire which not only caused significant damage to the building but also led to a number of different parties being sued - including the contractor himself who held a public liability insurance policy issued by Quinn. But Quinn declined to accept its liability on the grounds of an exclusion clause in the policy regarding the use of blow torches.

At the initial court hearing where the building’s owners sought compensation for the damage, judgement went against the contractor who, critically as it turned out, was unable to fund a defence and who subsequently went into voluntary liquidation. At which point, the building’s owners took up the case and pursued Quinn on the grounds that they should have indemnified the contractor.

Quinn, however, introduced a new argument, claiming that there was now a time bar on the issue because the dispute over liability under the public liability insurance policy had not been referred to arbitration within the nine month period prescribed by the policy. And in the first hearing of this case, the judge accepted Quinn’s defence.

But a subsequent Court of Appeal hearing overruled that judgement on the grounds that because the contractor had been unable to defend his case, the arguments against Quinn’s decision to deny its liability had never been tested and, therefore, no actual claim on the public liability insurance policy had arisen in order to bring the arbitration clause into effect. There had only been a potential claim.

According to an analysis of the case posted on morgan-cole.com, this Court of Appeal judgment confirmed that courts will always presume in favour of the insured in the event of ambiguity. And that, insurers should think very carefully before declining to pay out on a claim.
